Is my POA durable automatically? Yes — NY POAs survive incapacity by default unless you write otherwise
How many witnesses do I need? Two disinterested witnesses (the notary may serve as one; your named agent may not)
Does my bank have to honor it? A form that substantially conforms to §5-1513 earns a safe-harbor — banks are far more likely to accept it now
Can my agent give away my money? Up to $5,000 aggregate per year without a special grant; larger gifts or gifts to the agent require an express modification
Does a financial POA cover health decisions? No. You need a separate Health Care Proxy for medical choices

The Three Mistakes That Void a NY POA

  1. Skipping notarization. NY law requires acknowledgment before a notary in the same manner as a real-property conveyance — not just a signature.
  2. Naming your agent as a witness. A witness may not be the named agent or a permissible gift recipient. One invalid witness voids the entire document.
  3. Choosing a springing POA without a clear trigger. A springing POA only activates on a stated future event (such as incapacity). If the triggering language is vague, third parties cannot verify it and will refuse to honor the document. A durable POA is simpler for most families.
